SB 79 | TRANSIT-ORIENTED HOUSING

SB 79 Housing Development in Los Angeles

California SB 79, the Abundant and Affordable Homes Near Transit Act, establishes a transit-oriented housing framework for qualifying residential, mixed-use, and commercial sites near specified transit stops. It took effect July 1, 2026, but Los Angeles has adopted local low-rise and phased-implementation ordinances that affect how eligibility is determined.

What JDJ evaluates

  • City jurisdiction and parcel-specific ZIMAS eligibility mapping
  • Distance to qualifying transit stops and applicable TOD tier
  • Allowable density, height, and residential floor area ratio
  • Minimum project size, affordability obligations, and site exclusions
  • Interaction with CHIP, State Density Bonus Law, and local ordinances
  • Approval pathway, objective standards, and required agency reviews

Important: SB 79 does not automatically grant ministerial approval or override all site constraints. Projects generally must contain at least five dwellings, and applicability is subject to current state and local rules. Unincorporated Los Angeles County has a different implementation timeline.

Which Program Fits Your Project?

Program availability depends on location, project type, affordability, and current law. Use these summaries as a starting point—not an eligibility determination.

Qualifying housing developments may be eligible for increased density and other statutory benefits. Affordability commitments, eligibility thresholds, and applicable local standards must be verified for the specific site.

State Density Bonus Law

Qualifying housing developments may be eligible for increased density and other statutory benefits. Affordability commitments, eligibility thresholds, and applicable local standards must be verified for the specific site.

Transit-Oriented Housing Incentives

Transit proximity may affect applicable local housing programs and development standards. Existing and successor program rules must be confirmed for the parcel; transit proximity alone does not guarantee eligibility.

SB 79 Transit-Oriented Housing

SB 79 establishes housing development standards near qualifying transit stops. In Los Angeles, check ZIMAS eligibility and the City’s adopted Low-Rise and Phased Implementation Ordinances. Evaluate applicable transit tier, height, density, FAR, affordability, and parcel exclusions. SB 79 does not itself guarantee ministerial approval.

SB 9

For qualifying single-family parcels, SB 9 may provide pathways for residential development and urban lot splits. Exclusions, owner-occupancy requirements where applicable, tenant protections, and site conditions require review.

FREQUENTLY ASKED QUESTIONS

Density Bonus in Los Angeles

Answers to common early-stage questions about eligibility, incentives, and approvals.

How do I know whether my project qualifies for a density bonus?

Start with the property’s jurisdiction, zoning, proposed housing mix, affordable unit commitments, and applicable statutory and local requirements. A parcel-specific eligibility review is necessary.

What incentives or concessions may be available?

Depending on eligibility, State Density Bonus Law may provide density increases, incentives or concessions, waivers, and parking-related benefits. The scope depends on the qualifying project and governing law.

Can I combine density bonus with CHIP or other programs?

Some provisions may interact, but benefits cannot be assumed to stack. The specific program language, applicable state law, and City interpretation must be evaluated together.

What is SB 79 and does it apply to my Los Angeles property?

SB 79 is California’s transit-oriented housing law. Eligibility depends on the parcel’s jurisdiction, qualifying transit stop, applicable TOD tier, local implementation rules, site exclusions, and project requirements. Check the City’s SB 79 resources and ZIMAS maps for a parcel-specific starting point.

Does SB 79 automatically allow ministerial approval?

No. SB 79 sets applicable land use and development standards for qualifying projects, but does not by itself establish a universal ministerial approval process. Other streamlining statutes may apply if their separate criteria are met.

Does my project need a public hearing?

It depends on the entitlement pathway and whether separate discretionary approvals are required. Certain qualifying approvals may be ministerial, while other requests can involve hearings.

How long does approval take?

Timing varies based on project scope, application completeness, required studies, agency comments, and discretionary versus ministerial review. A project-specific schedule is more reliable than a universal estimate.

What constraints can reduce achievable unit count?

Common issues include easements, utility capacity, fire access, building code requirements, site geometry, slopes, and applicable development standards.
