Compatibility Rules That Shape a DBC Project

Two categories of rules under Austin’s Citywide Density Bonus Program get the least attention in generic summaries and the most influence on how a project actually gets designed: the residential-and-frontage requirements, and the compatibility relief the program offers near adjacent properties. Both affect building massing, cost, and layout directly, and both should be tested well before a rezoning application is filed.


The 65% Residential and 75% Frontage Requirements

Participating DBC projects generally must be at least 65% residential, meaning no more than 35% of the development can be non-residential. Separately, at least 75% of building frontage along a principal street generally must contain pedestrian-oriented commercial or civic uses, subject to the code’s standards and any applicable site-specific modifications.

These are two distinct requirements, and satisfying one does not guarantee satisfying the other. A project can hit the 65% residential threshold with room to spare and still fail the frontage requirement if its ground floor along the principal street isn’t designed around pedestrian-oriented uses.


What the Frontage Requirement Means for Design

A 75% frontage requirement is not a minor design note. It generally means commercial or civic space has to be planned into the building along the qualifying street frontage from the start, rather than treated as leftover square footage wherever it happens to fit.

That has knock-on effects across the building:

  • Building depth. Ground-floor commercial space often needs different floor-to-floor heights and structural spans than residential units above, which affects how the whole building is designed, not just the ground floor.
  • Loading access. Commercial frontage requirements can conflict with where a project would otherwise want to locate loading docks or service access, particularly on narrower sites.
  • Parking access. Vehicle access points for residential parking may need to be relocated away from the qualifying frontage to preserve pedestrian-oriented street presence.
  • Residential lobby placement. The residential entrance may need to move to a secondary frontage if the principal street is committed to commercial uses, which affects the overall site plan.

Retail Feasibility Should Be Tested Early

A project satisfying the letter of the frontage requirement is not the same as a project where that ground-floor commercial space actually works as a business proposition. On corridors with weak pedestrian activity, mandated commercial frontage can sit vacant or underperform for years, which drags on a project’s overall returns even if the residential units above lease well.

This is worth testing at the feasibility stage, not after the building is designed. The location of non-residential space, and whether the surrounding corridor can realistically support it, should factor into both construction cost assumptions and long-term operating projections before a client commits to the tier and program strategy that requires it.


Compatibility Relief Near a Triggering Property

DBC offers meaningful flexibility for complying projects, but that flexibility operates within limits tied to nearby “triggering” properties, generally properties with characteristics that activate Austin’s compatibility standards.

Flexibility available under the program includes:

  • No maximum floor-area ratio for complying developments.
  • No maximum density or minimum site-area requirement under the program’s stated standards.
  • Relief from certain side, interior, and front yard setbacks.
  • A 25-foot compatibility buffer along a property line shared with a triggering property.
  • A maximum building height of 90 feet within the band between 25 and 50 feet from a triggering property.
  • No compatibility standards beyond 50 feet from a triggering property under the program’s described structure.

In practical terms, a site’s distance from a triggering property can matter as much as its DBC tier in determining what actually gets built. A parcel eligible for DBC60 that sits within 25 feet of a triggering property will face a materially different buildable outcome than an otherwise identical parcel with no triggering property nearby.


Why This Section Belongs in Feasibility, Not Design

The residential and frontage percentages, and the compatibility distances from any triggering property, are both knowable early, before a client invests in architectural design. Testing them at the feasibility stage catches conflicts, a frontage requirement that doesn’t work commercially, a triggering property that caps height below the target tier, while they’re still cheap to address, rather than after a design team has already built a scheme around assumptions that don’t hold up.
